Accounts

You are responsible for maintaining the confidentiality of your account credentials and for activities under your account.

Notify us immediately of any unauthorized use of your account. You must provide accurate, current, and complete information during registration and keep it updated.

We may suspend or terminate accounts that violate these Terms or present risks to security or integrity of our services.

Payments

All prices are in CAD. Taxes (HST/GST/PST) may apply based on your province or territory.

Unless otherwise stated, course fees are due upfront at the time of purchase. If you are on a subscription plan, you authorize recurring charges until you cancel.

Refunds are governed by our Refund Policy. Where applicable, partial refunds may be prorated based on course access and time elapsed.

Content

Course materials are licensed for personal learning only. Do not redistribute without permission.

You may not copy, share, record, or publicly perform any part of our content without written consent. We reserve all intellectual property rights not expressly granted.

User-submitted content (assignments, recordings, messages) must not infringe the rights of others. You grant us a limited license to host and display such content for learning and support.

Prohibited Use

Do not attempt to disrupt our services, scrape data, or infringe third-party rights.

Examples of prohibited conduct include: reverse engineering; bypassing access controls; automating account creation; sending malicious code; harassment or abuse of instructors or students.

We may investigate activities that appear to violate these Terms and cooperate with law enforcement where required by law.

We implement reasonable safeguards to protect personal data; however, no method of transmission or storage is 100% secure. You are responsible for safeguarding your devices and passwords.

Third-Party Services

Our site may reference third-party tools (e.g., payment processors, video platforms). Their terms and privacy policies govern your use of those services.

We are not responsible for content, policies, or practices of third parties and disclaim liability arising from your interactions with them.

Student Conduct

Maintain respectful communication in classes, community spaces, and live sessions. We may remove content or limit access if we determine conduct is disruptive or harmful.

Impersonation, academic dishonesty, or attempts to gain unfair advantage are prohibited.

Certification and Outcomes

Completion certificates (where offered) reflect course completion, not professional licensure. We do not guarantee specific results or outcomes from training.

Disclaimers

Our services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim warranties, express or implied, including merchantability and fitness for a particular purpose.

Limitation of Liability

To the extent permitted by law, Pluvera Voice Academy shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

In no event shall our aggregate liability exceed the amount you paid for the service in the twelve (12) months preceding the claim.

Indemnity

You agree to indemnify and hold us harmless from claims arising out of your use of the services, your content, or your violation of these Terms or any applicable law.

Suspension and Termination

We may suspend or terminate access for violations of these Terms or for compliance and safety reasons. You may cancel at any time as described in your account settings.

Changes

We may update these Terms. Continued use signifies acceptance.

Material changes will be communicated by reasonable means (e.g., notice on the website). The effective date will be indicated at the top of the Terms page.

Governing Law; Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein, without regard to conflict of laws principles.

Before initiating formal proceedings, you agree to attempt informal resolution by contacting our support team. If unresolved, disputes shall be brought in the courts located in Toronto, Ontario, unless otherwise required by applicable law.
